question
Is it Haram to steal something back from someone who has already stolen it from you?
Concise answer
There is no problem if you believe the object is the one that has been stolen from you and you are not able to take it back legally and peacefully, but it should be done with no mischief.
Appendix:
The grand jurisprudent’s verdict in this regard is as follows:[1]
Office of Grand Ayatollah Sistani (may Allah grant him long life):
There is no problem if the object is the stolen thing itself.
Office of Grand Ayatollah Makarem Shirazi (may Allah grant him long life):
There is no problem if you believe the stolen thing is yours for sure and you are not able to take it back legally, but it should be done with no mischief.
Office of Grand Ayatollah Saafi Gulpaigani (may Allah grant him long life):
There is no problem in this regard if you are taking back your own property.
An answer by Ayatollah Mahdi Hadavi Tehrani (may Allah grant him long life):
There is no problem to take it if you believe the thing is the same thing that has been stolen from you and there is no possibility to take it back legally and with no immorality in doing so. But you will be able to take the equivalent of the stolen object from the usurper’s (Ghasib) properties if the original thing is wasted and there is no possibility to reach your right legally.
